Case Synopses

U.S. v. Short, W.D. Pa., 1993: Landlord who harassed tenants with AIDS because he did not want them living on his property violated the Fair Housing Act.
HUD v. Burns Trust, ALJ 1994: Landlord who evicted tenant with AIDS and his domestic partner violated the Fair Housing Act and assessed $78,000 in emotional distress damages.
Coleman v. Zatechka, Neb. 1993: University policy precluding students who require personal care attendant from participating in roommate assignment program violated Section 504 and ADA.
Peabody v. Sherman, Mass. 1994: Landlord who evicted disabled tenant because of conviction of possession of drugs with intent to distribute did not violate Fair Housing Act.
Hertwig v. Wright, N.Y. 1995: Cooperative could bring eviction proceedings against mentally disabled tenant who posed a threat to the safety of other tenants.
HUD v. Dedham H.A., ALJ 1991: Refusal to assign a reserved parking space to a mobility impaired tenant violates Fair Housing Act.
Shapiro v. Cadman, N.Y. 1994: Apartment building must make reasonable accommodation for physically disabled tenant by assigning her a parking place in close proximity to the building.
Lincoln v. Penn., Penn. 1991: Landlord must allow tenant with multiple chemical sensitivities to make reasonable modifications to her apartment at her expense.
Roe v. Sugar River, N.H. 1993: Apartment complex must attempt to accommodate tenant’s mental disability on request before it can evict him on the grounds that he is a direct threat to others.
Woodside v. Hertzmark, 1993: Fair Housing Act not violated by federally assisted housing provider in evicting mentally disabled tenant who could not control his dog even with reasonable accommodation.
Congdon v. Strine, Pa. 1994: Landlord was not required to construct a new elevator requested as a reasonable accommodation by tenant in a wheelchair; his offer of a first floor apartment and having a service maintenance contract for elevator repair was sufficient.
U.S. v. Cal. MHP, 9th 1994: Landlord who refused to waive guest fee and guest parking fee for a home health care aide of a tenant with a physical disability violated the Fair Housing Act.
HUD v. Riverbay, ALJ 1994: Landlord who refused to allow mentally disabled tenant to keep her dog, which was necessary to improve her recurrent depression, violated Fair Housing Act.
Roseborough v. Cottonwood, Ill. 1994: Landlord who refused to transfer a physically disabled tenant from a third to a first floor apartment may be in violation of Fair Housing Act.
