The Ninth Circuit Court of Appeals, in December 2007, decided a case involving disability discrimination and job qualification standards. Although the Court did not give a definitive answer regarding the particular job qualification standards put into place by the employer, the Court did set forth some important guidelines for employers.
The Ninth Circuit Court of Appeals, in Gambini v. Total Renal Care, Inc., 486 F.3d 1087 (2007), has found that an employer may not be able to terminate the employment of an employee for misconduct, if the misconduct is related to the employee’s disability.
